Copyright Policy

I. Introduction

This Copyright Policy (“Policy”) applies to the 10 Spot website and mobile applications (collectively, the “Services”). This Policy outlines the intellectual property rights associated with the Services and the acceptable use of copyrighted materials.

II. Ownership of Content

The Services and their content, including text, graphics, logos, images, audio, video, software, and other materials (collectively, the “Content”), are protected by copyright, trademark, and other intellectual property laws. The Content is owned by 10 Spot, its licensors, or third-party content providers.

III. Limited License to Use the Services

10 Spot grants you a non-exclusive, non-transferable, limited license to access and use the Services for personal and non-commercial purposes. This license does not permit you to:

  • Modify, translate, reverse engineer, decompile, disassemble, or create derivative works from the Content.
  • Reproduce, distribute, publicly display, or perform the Content, except as expressly permitted by this Policy.
  • Remove, obscure, or alter any copyright notices or other proprietary rights notices contained in the Content.
  • Use the Services for any illegal or unauthorized purpose.

IV. User Content

The Services may permit users to submit, post, or display content (“User Content”). You retain all copyright and other intellectual property rights you own in your User Content. By submitting User Content, you grant 10 Spot a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and publicly display your User Content on the Services and in promotional materials. You warrant and represent that you have all necessary rights and licenses to grant the foregoing license.

V. Digital Millennium Copyright Act (“DMCA”)

10 Spot respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a notification in accordance with the DMCA. VI. Notice and Takedown

10 Spot will respond to notices of alleged copyright infringement submitted in accordance with the DMCA. If you believe that your User Content has been infringed upon, please submit a notification to our customer service team.

Your notification must comply substantially with the following requirements:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is alleged to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit 10 Spot to locate the material.
  • Information reasonably sufficient to permit 10 Spot to contact the complaining party, such as an address, a telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

VII. Termination

10 Spot reserves the right, in its sole discretion, to terminate your access to and use of the Services if you violate this Policy.

VIII. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of laws provisions.

IX. Changes to this Policy

10 Spot reserves the right to modify this Policy at any time by posting the revised version on the Services. You are advised to periodically review this Policy for any changes.
